1. Agreement to Terms 

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Delaney Agency, LLC ("we," "us," or "our"), concerning your access to and use of the www.DelaneyMPLS.com website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the "Site"). 

You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF SERVICE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND MUST DISCONTINUE USE IMMEDIATELY. 

2. Intellectual Property Rights 

Unless otherwise indicated, the Site is our proprietary property. All content, text, graphics, logos, images, audio, video, and the selection and arrangement thereof (collectively, the "Content") and the trademarks, service marks, and logos contained therein ("Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws. 

  • Books and Published Works: All books, novels, guides, and other published works promoted or linked on this Site are the exclusive copyrighted property of the listed authors or their related pseudonym and may not be reproduced, redistributed, or used for commercial purposes without our express written permission. 

  • Limited License: Provided you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. 

3. Products, Purchases, and External Sales 

A. Product Availability 

All books and products listed on the Site are subject to availability. We reserve the right to discontinue any product at any time for any reason. 

B. External Sales Links (Amazon, Bookstores, etc.) 

Our Site acts primarily as a promotional and informational platform. Any links provided for purchasing our books (e.g., links to Amazon, Barnes & Noble, independent bookstores, etc.) direct you to third-party retailers. 

  • Disclaimer on Sales: When you click on a link to purchase a book, you are leaving our Site. Your purchase transaction will be governed by the terms and conditions and privacy policies of that third-party retailer. 

  • Order Issues: We are not responsible for the ordering process, shipping, returns, refunds, or quality of service provided by the external retailer (e.g., Amazon). All 

  • issues related to payment, fulfillment, and delivery must be directed to the respective third-party seller. 

C. Direct Sales (If applicable) 

If we sell any digital products (e.g., direct-download eBooks, lead magnets) or merchandise directly on this Site, those sales will be governed by the refund/return policy explicitly stated at the point of sale. 

4. User Representations 

By using the Site, you represent and warrant that: (1) you have the legal capacity and you agree to comply with these Terms of Service; (2) you will not use the Site for any illegal or unauthorized purpose; (3) your use of the Site will not violate any applicable law or regulation. 

5. Prohibited Activities 

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those specifically endorsed or approved by us. 

Prohibited activities include, but are not limited to: 

  • Systematically retrieving data or other content from the Site to create or compile a collection, compilation, database, or directory without written permission from us. 

  • Making any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email. 

  • Attempting to bypass any measures of the Site designed to prevent or restrict access to the Site, or any portion of the Site.

  • We do not investigate, monitor, or check Third-Party Websites and Third-Party Content for accuracy, appropriateness, or completeness. 

  • Inclusion of any links does not imply approval or endorsement by us. If you decide to leave the Site and access the Third-Party Websites or use any Third-Party Content, you do so at your own risk.

We reserve the right, but not the obligation, to: (1) monitor the Site for violations of these Terms of Service; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms of Service; and (3) otherwise manage the Site in a manner designed to protect our rights and property and facilitate the proper functioning of the Site.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 

WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SITE’S CONTENT OR THE CONTENT OF ANY WEBSITES LINKED TO THE SITE AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS, (2) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SITE.

These Terms of Service and your use of the Site are governed by and construed in accordance with the laws of Minnesota, United States, applicable to agreements made and to be entirely performed within Minnesota, United States, without regard to its conflict of law principles.
